Selling or purchasing a house in Italy is not always as smooth as we can nicely illustrate by the case of one of our German clients.
They knew the mountainous region of the Modena province in Emilia-Romagna quite well and wanted to go and live there. So we searched quite specifically for a suitable house in the mountains south of Modena and Bologna.
In March 2024, we found a beautiful house in Pavullo nel Frignano, but even before we started negotiations, it turned out that the house had been blocked by the Italian authorities due to building violations.

The owner had ventured into a Rent-to-Buy transaction, but the buyer committed building violations of which the owner was unaware. The sale ultimately fell through, and the owner regained his house, along with building violations and a seizure, following a legal investigation into the violations. The situation was complex, but there were ways to rectify the situation. However, the expected timeframe for this was rather uncertain. We managed to reach an agreement between the parties. The contract gave the owner ample time to handle the matter with the law, and the buyer the option to unilaterally terminate the agreement if the matter dragged on too long.
More than a year later, the waiting came to an end for our buyer. In April of this year, his patience was rewarded, and finally, he could sign the purchase contract in the office of a notary public in Modena. In this case, we were able to count on excellent cooperation with the experienced real estate agent Archimede from the Tecnocasa office in Pavullo nel Frignano.
